FlashMath Education Terms of Service (US)
The terms that govern FlashClass and FlashEDU plans: plans and seats, school responsibilities, data use limits, billing, renewal and cancellation, and data export and deletion.
Version 2.1 · Effective 2026-09-28 · Questions: education@flashmath.io
Introduction
These Education Terms of Service ("Education Terms") are a binding agreement between the subscribing educator, school or district ("School," "you," or "your") and FlashMath LLC ("FlashMath," "we," "us," or "our") governing your access to and use of FlashMath's education plans, FlashClass and FlashEDU (together, the "Education Services").
By purchasing or activating an education plan, you agree to these Education Terms. If you do not agree, do not use the Education Services. These Education Terms supplement FlashMath's general Terms and Conditions, published at flashmath.io, and take precedence over them where the two conflict with respect to the Education Services.
1. Scope
- These Education Terms apply to FlashClass and FlashEDU plans used in the United States for educational purposes.
- Our Education Privacy Policy, published at https://edu.flashmath.io/legal/privacy, explains how we collect, use and disclose personal information in the Education Services.
- FlashMath's consumer accounts and plans (FlashMath+ and FlashFamily) are governed by FlashMath's general Terms and Conditions and Privacy Policy.
2. Education Plans
2.1 FlashClass
- FlashClass is for individual educators, tutors and small groups. It is available as a free tier and as FlashClass Pro, a recurring subscription billed monthly or yearly.
- Each plan includes a fixed number of student accounts and active classrooms, shown before you choose a plan. Enrolling a student beyond your plan's allowance is refused; FlashClass never charges per student.
- We may offer promotional pricing for FlashClass Pro. Any promotional price and the standard renewal price are both disclosed before purchase.
2.2 FlashEDU
- FlashEDU is an annual school or district license. The standard plan includes a fixed number of student seats and a limit on how many students can be active at the same time, both stated before purchase. Student accounts stop at the district's registered-student limit, and a district can ask us to raise that limit.
- Extra seats. A district that pays by card is billed for each extra seat: each student above the seats its plan includes, at the annual per-extra-seat rate in its Order Form. Extra seats are the number of different students with an active enrollment in a class that is not archived, at one of the district's active schools, minus the included seats; a student in several classes counts once. The count is updated whenever enrollment changes, and our payment processor prorates each change over the rest of the current term and adds it to the district's next invoice. A district billed by invoice or purchase order is not billed for extra seats automatically; its seats are those in its Order Form, quote or agreement.
- Larger schools and districts, and custom arrangements, are priced by quote.
- A district's FlashEDU license is governed by the agreement it signs — the FlashEDU subscription agreement and Order Form, or a negotiated master agreement — and by the FlashEDU Student Data Privacy Agreement, published at https://edu.flashmath.io/legal/dpa. Those documents control over these Education Terms for that district.
3. Roles and Responsibilities
3.1 School Responsibilities
- You are responsible for obtaining all consents required by law before allowing students to use the Education Services, including consent under the Children's Online Privacy Protection Act (COPPA) and the Family Educational Rights and Privacy Act (FERPA) where applicable.
- Where COPPA applies, the School may consent on behalf of parents to the collection of student personal information for an educational purpose, as the FTC's COPPA Rule allows.
- You represent that you have the authority to agree to these Education Terms on behalf of the School, and that you have obtained or will obtain all required consents before creating or authorizing student accounts.
- You are responsible for appropriate use of the Education Services by your students and staff.
- You must promptly notify us of any changes to student enrollments, including students who should no longer have access.
3.2 FlashMath Responsibilities
- We will provide the Education Services as described and will not use student personal information for purposes materially different from providing and improving the Education Services.
- We will not use student personal information for targeted advertising or build advertising profiles from student data.
- We will maintain reasonable security measures to protect student data, as described in the Education Privacy Policy.
- We will cooperate with the School to respond to parent requests about student data, subject to verification.
4. Student Accounts
- Student accounts created under an education plan are managed by the subscribing educator or school administrator.
- Students under 13 use the Education Services through accounts the School or teacher creates, where the School has provided consent as described in Section 3.1. Registration with an email address and password is refused for anyone under 13.
- A student aged 13 or older may register with an email address and password and join a class with a class code the teacher shares.
- Student accounts may have fewer features than consumer accounts, as determined by plan features and educator and district settings.
- Student data remains associated with the School's education plan for the duration of the subscription.
5. Data Use Restrictions
- Student personal information collected through education plans is used only to provide, maintain, support and improve the Education Services, and for legitimate educational purposes.
- We will not sell student personal information.
- We will not use student personal information for targeted advertising.
- We will not use student data to create advertising profiles.
- De-identified or aggregated data that cannot reasonably identify individual students may be used for product improvement, research and analytics.
6. FERPA
- To the extent student data constitutes "education records" under FERPA, FlashMath acts as a "school official" with a "legitimate educational interest" under the School's direct control.
- FlashMath will not disclose student education records to third parties except as permitted by FERPA, directed by the School, or required by law.
- The School retains ownership and control of student education records.
- FlashMath will cooperate with the School to enable it to meet its FERPA obligations, including responding to parent requests for access to or amendment of education records.
7. COPPA
- For students under 13, the School acts as the parent's agent in providing consent under COPPA, as the FTC's COPPA Rule allows for educational use.
- We will collect only the personal information reasonably necessary to provide the Education Services to students under 13, and will not condition a student's participation on collecting more.
- Parents may review their child's personal information, request its deletion and refuse further collection. The School handles these requests, and FlashMath will cooperate in carrying them out.
8. Subscription and Billing
8.1 FlashClass Pro
- FlashClass Pro is billed on a recurring basis, monthly or yearly, at the rate disclosed at purchase, and renews automatically at the end of each billing period unless canceled.
- Where a promotional rate applies, renewal after the promotional period is at the standard rate disclosed at purchase.
- Each plan includes a fixed number of student accounts (Section 2.1). FlashClass never bills per-student or overage charges.
8.2 FlashEDU
FlashEDU is billed as stated in the district's Order Form, quote or agreement, and a district that pays by card is also billed for extra seats as Section 2.2 describes. The standard self-serve license runs for a 12-month term and renews automatically for a term of the same length unless the district cancels at least 30 days before the renewal date. Fees for a term that has begun are non-refundable and non-cancelable, except as the law requires. A negotiated agreement follows its own billing and renewal terms.
8.3 Cancellation
- You can cancel FlashClass Pro at any time from your FlashClass account page, which opens our payment provider's subscription page. Cancellation takes effect at the end of the current paid period: you keep Pro until then, and the period already paid is not refunded.
- A district cancels FlashEDU as described in Section 8.2 or in its agreement.
- After cancellation or expiration, student data is handled as described in Section 9.
9. Data Export and Deletion
- District administrators can export their district's student data from the district console while the district's service is active and, after its license ends, until the deletion begins ahead of the 90-day deadline. Confirming a request to delete the whole district ends export at once, so export first. Any School can also request an export by writing to education@flashmath.io.
- FlashEDU: after the district's license ends, or on the district's request, we delete or de-identify student personal information within 90 days, as the DPA describes. For a request a district administrator makes in the district console, the 90 days run from when it is made; for a written request sent to us, they run from when we confirm it.
- FlashClass: removing a student from a class ends the student's access to that class but keeps the student's account and practice history, and FlashClass does not delete student data just because a subscription ends or a teacher stops using it. A teacher can delete a student's data at a parent's or guardian's request, and a parent or guardian can ask through the public form at flashclass.edu.flashmath.io/data-deletion, which the child's teacher must confirm. A teacher can also close their FlashClass account: after a grace period, currently 14 days, during which they can cancel and download their class data, their classes' student data and their account are deleted. Closing a FlashClass Pro account stops the subscription from renewing at the end of the paid period. The Education Privacy Policy describes each of these in full.
- Some records are kept after deletion — the audit trail and, until they expire, encrypted backups — as the Education Privacy Policy describes. De-identified or aggregated data may be retained.
10. Security
- We implement reasonable administrative, technical and organizational safeguards designed to protect student data, described in the Education Privacy Policy.
- If a data breach affects student data, we will notify the School without unreasonable delay and as required by applicable law.
- We will cooperate with the School in investigating and responding to any security incident.
11. Disclaimers and Limitation of Liability
- The disclaimers and limitation of liability provisions in FlashMath's general Terms and Conditions apply to the Education Services, except as modified by these Education Terms or by a district's signed agreement.
- We do not guarantee specific educational outcomes.
12. Changes to These Education Terms
- We may update these Education Terms from time to time. If we make material changes, we will provide notice by reasonable means.
- Continued use of the Education Services after the effective date of a change constitutes acceptance, except where additional consent is required by law.
- Version 2.1 replaces version 1.1 (last updated August 29, 2026), which was published at flashmath.io/edu-terms. It says which FlashEDU districts are billed for extra seats — those that pay by card, not those billed by invoice or purchase order — and how extra seats are counted and billed; states the FlashEDU renewal and cancellation terms and how FlashClass Pro cancellation works; and describes data export and deletion as they operate.
